1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and AURA Smart Cards Inc. (“AURA”). By accessing our website, purchasing an NFC card via our WhatsApp concierge or digital forms, or configuring an AURA digital profile, you agree to be bound by all of these terms.

2. Scope of Services & Physical Goods

AURA designs, manufactures, laser-engraves, and distributes contactless NFC business cards, stickers, and digital contact management services. All hardware specifications (dimensions, weights, frequencies) are described to the best of our metallurgical and electrical testing standards.

3. Custom Laser Engraving & Customer Intellectual Property

By submitting corporate logos, personal monograms, or vector artwork for custom laser etching, you represent and warrant that:

• You own or possess the necessary trademark, copyright, or licensing permissions to reproduce the imagery.
• The artwork does not infringe upon any third party’s intellectual property or publicity rights.
• You grant AURA a non-exclusive license solely to fabricate the requested physical goods.

4. Lifetime Profile Service & Acceptable Use

AURA cards do not require ongoing subscription fees for standard individual profiles. However, users agree not to utilize their profile links to distribute malicious software, phishing links, unlawful materials, hate speech, or defamatory statements. AURA reserves the right to suspend or disable any digital profile found in material breach of acceptable use standards.

5. Hardware Warranty & Care Guidelines

AURA warrants that all cards are free from chip defects and transmission failures for a period of 12 months from purchase. This warranty does not cover normal aesthetic patina, scratches on metal coatings caused by sharp keys or coins, deliberate bending, exposure to temperatures exceeding 100°C, or microwave radiation.

6. Limitation of Liability

To the fullest extent permitted by applicable law, AURA Smart Cards Inc. shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from lost business opportunities, device incompatibilities with legacy mobile phones, or temporary internet server downtime.

7. Governing Law & Arbitration

These Terms shall be governed and interpreted in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any dispute arising from these terms shall be settled via binding individual arbitration in New York County.
